Dished — Customer App Terms and Conditions (UK)

1. Introduction
1.1 These Terms and Conditions ("Terms") govern your access to and use of the Dished mobile application, website and related services (the "App" or the "Service") operated by Dished Pvt Limited ("Dished", "we", "us" or "our").
1.2 By downloading, registering for, accessing or using the App you agree to be bound by these Terms. If you do not agree, do not use the App.
1.3 Capitalised terms used and not defined in this section have the meanings given elsewhere in these Terms.

3. Eligibility
3.1 The App is made available for use in the United Kingdom only.
3.2 Use of certain features requires registration. You must be legally capable of entering into contracts. Users under 18 should use the App only with the consent and supervision of a parent or legal guardian. By registering you confirm you meet these eligibility requirements.
4. Accounts, registration & security
4.1 To use certain features you must create an account. You must provide accurate, up-to- date information (including your real name, email and contact details).
4.2 Social login options (e.g., Facebook, Google) may be offered; by using them you authorize sharing of information from the social provider with Dished.
4.3 Your account is personal to you. Unless we expressly permit otherwise in writing, you may not: (a) register more than one account; (b) share, transfer or license your account to any third party; or (c) allow others to use your account.
4.4 You must keep your login details confidential and notify us immediately if you suspect unauthorised use. You are responsible for all activity on your account. We may suspend or block access where we reasonably suspect your account has been compromised.
5. Orders, restaurants & fulfilment
5.1 Dished is a technology platform that enables Customers to place orders with participating restaurants. When you place an order through the App you enter into a direct contract with the restaurant that accepts that order. The restaurant is responsible for preparing and fulfilling the order.
5.2 Dished passes to the restaurant any dietary and allergy information you provide. Restaurants remain solely responsible for food preparation, handling allergies, hygiene, safety and the accuracy and quality of items provided. Dished does not warrant or guarantee restaurants' compliance.
5.3 Estimated delivery or collection times are provided for convenience only and are not guaranteed. Delivery availability and estimated times depend on restaurant availability, third-party couriers and local conditions.
6. Payments, pricing & failed payments
6.1 All electronic payments are processed by Stripe (or such other nominated payment provider). We do not store your full card details.
6.2 You agree to pay the price displayed in the App at the time you place an order, together with any applicable delivery, service or other fees. Prices are set by restaurants (unless otherwise stated).
6.3 If an order cannot be fulfilled or collected for reasons attributable to you (for example you are not present at collection), you may be charged for the order and any delivery or other fees as set out at order placement.
6.4 If a payment cannot be honoured due to insufficient funds or other payment issues, Dished may suspend your access to the App until the payment issue is resolved.
7. Refunds & cancellations
7.1 Refunds and cancellations are handled by the restaurant that accepted your order unless the App or a Dished policy expressly provides otherwise. Where Dished does make a refund, it will be processed through the payment provider in accordance with that provider's procedures.
7.2 Any compensation for late, incorrect or unsatisfactory orders should be sought from the restaurant in the first instance; you may contact Dished customer support and we will assist to the extent we are able.
8. Dietary & allergy information — express consent
8.1 If you provide dietary, medical or allergy information via the App you acknowledge and consent to Dished processing and transmitting that information to the restaurant(s) necessary to fulfil your order. Example consent statement you should present when collecting such data:
"By providing your dietary or allergy requirements you consent to Dished processing that information and sharing it with the restaurant(s) necessary to fulfil your order."
8.2 You should not rely solely on the App for allergy safety — always confirm critical allergy information directly with the restaurant.
9. User conduct
9.1 You must not: (a) place fraudulent or abusive orders; (b) misuse promotions, discounts or loyalty offers; (c) impersonate others or provide false or misleading information; (d) use offensive, threatening, unlawful or abusive content in communications; (e) attempt to circumvent payment obligations or use multiple accounts to exploit the Service; or (f) use the App in breach of any law.
9.2 Dished may suspend, restrict or terminate your account for conduct that breaches these Terms or for behaviour that harms Dished, other users or restaurants.
10. User content, reviews & ratings
10.1 At present users may submit ratings. In future the App may permit comments, reviews, photos or other content ("User Content"). By submitting User Content you grant Dished a non-exclusive, worldwide, royalty-free licence to use, reproduce, adapt and publish that content.
10.2 You warrant that you have all rights necessary to submit User Content and that it does not violate any third party rights. Dished may moderate, remove, edit or refuse to publish User Content at its discretion.
11. Promotions, loyalty & referral programmes
11.1 Promotions, referral schemes and loyalty programmes are offered at restaurants' and/or Dished's discretion and may be modified or withdrawn at any time. Participation rules and any operational terms will be published in the App.
11.2 If you participate in a promotion or loyalty scheme you must comply with its published terms; Dished and restaurants may take corrective action (including reversing promotions, adjusting credits or revoking entitlements) where abuse or non-compliance occurs.
12. Intellectual property
12.1 Dished and/or its licensors own all intellectual property rights in the App and its content. You may not copy, reproduce, transmit, adapt or create derivative works of the App or its content except as expressly permitted.
13. Service availability & maintenance
13.1 The App may be unavailable from time to time for maintenance or other reasons. Dished does not guarantee uninterrupted or error-free access to the App. We may suspend access temporarily to perform updates or maintenance.
14. Warranties & disclaimers
14.1 The App is provided "as is" and "as available". To the fullest extent permitted by law, Dished expressly disclaims all warranties (whether express or implied) including merchantability, fitness for a particular purpose, accuracy, compatibility and non- infringement.
14.2 Dished does not warrant that restaurants will fill orders correctly or safely; that third- party delivery services will perform; or that the App will meet your expectations.
15. Limitation of liability & indemnity
15.1 To the fullest extent permitted by law, Dished shall have no liability to you for any indirect, incidental, special, consequential or punitive loss or damage whatsoever (including loss of profit, loss of business, loss of data or goodwill) arising from your use of the App or from any restaurant's provision of services or goods.
15.2 Dished's total aggregate liability to you for direct losses arising out of or in connection with these Terms shall be limited to £100 (or such greater amount required by applicable law). Nothing in this clause excludes liability for death or personal injury resulting from Dished's negligence or liability which cannot be excluded by law.
15.3 You will indemnify and hold Dished harmless from and against any claims, losses, liabilities and expenses (including legal fees) arising from your breach of these Terms, fraudulent acts, or misuse of the App.
16. Automated decision-making & profiling
16.1 We may use automated profiling or algorithms to personalise recommendations, offers or search results. If you object to automated processing that produces legal or similarly significant effects, contact legal@dished.uk to discuss your rights and options.
17. Third-party services & links
17.1 The App may contain links to third-party websites, services or social networks. Dished is not responsible for third-party content or privacy practices. Your use of third-party services is at your own risk.
18. Data protection & privacy
18.1 Our Privacy Notice (displayed in the App and on our website) explains how we collect, use and store your personal data, your rights and how to exercise them. The Privacy Notice forms part of these Terms.
18.2 You may request deletion of your personal data or account by contacting legal@dished.uk; requests will be handled in accordance with applicable law and our Privacy Notice.
19. Data retention
19.1 Except where otherwise required by law, we will retain your personal data only as long as necessary for the purposes set out in the Privacy Notice. You may request deletion of your data at any time.
20. Accessibility
20.1 Dished aims to provide reasonable accessibility but does not guarantee that the App is compatible with all devices, assistive technologies or browsers. We will consider accessibility improvements as the Service develops.
21. Changes to these Terms
21.1 We may update these Terms from time to time. Where we make material changes we will notify you by email or in-app notification. Continued use of the App after notification constitutes acceptance of the revised Terms.
22. Dispute resolution
22.1 If you have a complaint, contact us at legal@dished.uk and we will try to resolve it. If we cannot resolve a dispute amicably within a reasonable period, you and Dished agree that the courts of England and Wales shall have exclusive jurisdiction to resolve the dispute.
23. Force majeure
23.1 Neither party will be liable for delay or failure to perform caused by events outside its reasonable control (e.g., strikes, natural disasters, pandemics, telecommunications failures).
24. Miscellaneous
24.1 Assignment — We may assign or transfer our rights and obligations under these Terms (including by sale of the business). You may not assign your rights without our prior written consent.
24.2 Entire agreement — These Terms, together with the Privacy Notice and any other documents expressly referred to, constitute the entire agreement between you and Dished.
24.3 Severability — If any provision is held invalid, the remaining provisions will remain in force.
